Terms and Conditions

These Terms and Conditions (the "Terms and Conditions") govern the use of the website powerflowpr.com (the "Site"). This Site is owned by Tropichart Contractors Group LLC and is operated by Power Flow P.R. This Site serves as a "networking" platform.

By using this Site, you indicate that you have read and understood these Terms and Conditions and agree to always comply with them. These Terms and Conditions are governed by the laws of the Commonwealth of Puerto Rico. By using this Site, you agree that any legal disputes will be resolved exclusively in the courts of Puerto Rico.

1. Intellectual Property

All content published and available on our Site is the property of Tropichart Contractors Group LLC and Power Flow P.R. and the Site's creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site. Users are granted a limited license to access and use the content solely for personal, non-commercial purposes. Unauthorized reproduction, distribution, or modification of any content is strictly prohibited unless expressly authorized by Tropichart Contractors Group LLC and Power Flow P.R.

Any unauthorized use of the Site's content, particularly in relation to distribution activities, must comply with the provisions of Law No. 96 of June 5, 1973, which regulates multilevel distribution companies in Puerto Rico.

2. Age Restrictions

The minimum age to use our Site is 18 years old. By accessing and using this Site, you confirm that you are at least 18 years old. We do not assume legal responsibility for any false statements regarding age.

Users who participate in any commercial activities or programs related to Tropichart Contractors Group LLC and Power Flow P.R. must be at least 18 years old, as required by applicable laws in Puerto Rico. However, certain transactions or agreements may require additional legal capacity, in accordance with the legal age of majority in Puerto Rico.

3. Accounts

When you create an account on our Site to become a member of the Power Flow P.R. Network, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account.
  2. All personal information you provide to us through your account is up to date, accurate, and truthful, and you agree to update your personal information if it changes.

We reserve the right to suspend or cancel your account if you use our Site illegally or violate these Terms and Conditions. Any fraudulent or improper use of accounts will be subject to the applicable laws of the Commonwealth of Puerto Rico. Any violation of this nature may result in account suspension and appropriate legal action.

You must pay the amount that will be displayed on your balance page in a format every thirty (30) days for seventeen (17) months, following the initial deposit, so that you may receive your corresponding commissions from each of the levels until you complete your six (6) levels. Each level consists of ninety (90) days, for a total of six (6) primary cycles and a total of five hundred forty (540) days.

Each structure ends in month 21 because that is when your last sales representative within your structure has completed their six (6) levels and the final commission payment will be on or before ninety (90) days from the completion of month 21 of your complete structure. Just after everything is calculated by our accountants, prepared for final payment and for sending the 480-A for residents of Puerto Rico.

It is very important that you comply with making deposits to your product balance as part of your acceptance of our terms and conditions for you to continue receiving economic remuneration that comes from commissions up to six levels. By doing so, you will avoid penalties and fines for non-compliance with the process.

The final payment will be sent to you by paper check, digital check, or direct deposit to the bank account you provided to us in your registration, provided that you reside in the United States of North America and any of its territories. International payments will be sent through FedEx; you must provide the complete and correct address.

4. Sale of Goods on Layaway

The products on our Site are offered through a layaway sales system, where you can reserve one or more products by making a single deposit, which will be deducted from the total price of the products.

The product will begin its shipping process once full payment is completed. Delivery time will depend on various factors such as: (1) inventory availability (if it is completed, as soon as it has been produced it will be sent to you); (2) Acts of Nature; (3) Shipping conditions by the shipping company; (4) Conditions imposed by the United States of North America. Product receipt will be thirty (30) business days or more depending on circumstances.

These Terms and Conditions apply to all products displayed on our Site at the time you access it, including those listed as out of stock which may later become available. While we strive to ensure that all information, descriptions, or images of our products are accurate, we do not guarantee the accuracy or completeness of this information. You agree to purchase products at your own risk.

Products purchased through the Tropichart Contractors Group LLC and Power Flow P.R. Network "layaway" program do not apply a return format because part of this format is that through the acquisition of these products you are creating your business to generate commissions from sales in a separate format (layaway). These Terms and Conditions apply because the acquisition and payment of this product is a condition to be an active sales representative to obtain your direct commissions and those of those in your business structure.

The initial deposit of one hundred twenty-five ($125.00) dollars, which is non-refundable under any circumstances. This deposit will be applicable to the product or products chosen by you within the participant program system. Tropichart Contractors Group LLC and Power Flow P.R. reserve the right to modify, reject, or cancel your order when deemed necessary, with proper notification provided.

If the product selected at the time of your layaway purchase is out of stock, we will send a similar replacement product of equal quality and cost, ensuring that you receive a product that meets the specifications. In compliance with Law No. 96 of June 5, 1973. The Tropichart Contractors Group LLC and Power Flow P.R. Commission Plan is based solely on product sales made by sales representatives and not on the recruitment of new participants through layaway format purchases.

5. Cumulative Process System:

Sales representatives of Tropichart Contractors Group LLC and Power Flow P.R. earn points directly from participants who make a layaway and from the layaway made by the sales representatives they supervise within the powerflowpr.com hierarchical structure.

The organizational structure consists of the following levels:

  • Sales Representative: earns points for each direct sale under the layaway program they make.
  • Sales Representative Coordinator: earns points from both their direct layaway sales and from the layaway sales made by the sales representatives under their supervision.
  • Sales Representative Unit Supervisor: earns points based on the layaway made by the coordinators under their supervision, as well as on their team's sales.
  • Sales Representative Unit Manager: Earns points based on the layaways of the supervisors and their entire sales team.
  • Business Unit Sales Leader: Oversees the overall performance of the entire business unit and earns points based on the total sales performance of their team.
  • Sales Network Structure Manager: reaches this point when all levels under their six (6) level network structure are completed.

Layaway Conditions and Points:

Sales representatives are not required to maintain or purchase inventory monthly as a condition to advance within the Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan. The points generated by each layaway are made under the layaway sales representative at each level, then only when you complete the eighteen (18) months or the six (6) level configuration through our system.

All sales representatives have ninety (90) days to complete their sales level under the layaway format; during this period it is recommended that you make as many sales as possible on our powerflowpr.com platform so that your structure is one that provides you with the greatest income opportunity through direct and indirect commissions in your six (6) levels. Levels are completed as soon as ninety (90) days are completed.

You will receive payment of your commissions after the deduction of 10% for Tax purposes for being sales representatives of Tropichart Contractors Group LLC and Power Flow P.R. and another ten (10%) percent deducted for maintenance services, credit card service, accounting processes and Power Flow P.R. operating system administration.

Sales representatives from the 48 contiguous states and other territories outside Puerto Rico will only have the fifteen (15%) percent retention applied to cover the accounting process, costs of payment services for credit cards used by individuals when making payments, and maintenance of the powerflowpr.com platform operating system owned by Tropichart Contractors Group LLC and Power Flow P.R.

Before completing your six (6) cycles in the network and receiving your final payment, including form 480-A for residents of Puerto Rico and any other document required by the IRS for residents of the 48 contiguous states, your product must be fully paid in order to receive your final commission payment and begin the shipping process. And if you failed to make your monthly payments or multiple payments, you will have a fine of five (5%) percent of the total of your last commission payment from your last level of your business structure.

What happens if my structure does not complete with six (6) levels?

If in a 6-level or 18-month structure, the participant who has a sales structure does not reach the sixth level with a minimum of six (6) per member under their structure, you will receive payment for the total cumulative amount reached during those six (6) levels, including if they did not achieve the minimum of six (6) in their direct line; here all amounts you achieve during the course of your six (6) levels will be paid. You must wait for the six (6) levels to expire for your structure to close automatically, and it closes when your last representative brought by you directly in the first 90 days of the start of your structure has completed their five hundred forty (540) days equivalent to the six (6) levels.

It is very important that you, like the other sales representative members of your network structure, sponsor your members and support them, so that each one can achieve the maximum of layaway sales under each one's network for your benefit as a leader and for the eventual benefit of each of them when they move to the next leadership level and replicate the process.

We remind you that the maximum of Sales Representatives you can achieve under your sales structure is forty-five (45) during your first ninety (90) days, through the sale in layaway format of any of the products in the powerflowpr.com Network in a period of ninety (90) days. The more you achieve, the greater your income benefits will be for each completed cycle, provided that the sales representatives in your network comply with making a minimum of six (6) up to a maximum of 45 sales representatives through layaway in their direct networks. If they make less than six (6), we will comply with the payment of all types of commission that you achieve; the minimum structure of six (6) participants is for your own benefit in the scale of greater projected income opportunity.

Can I see how my network layaway structure is increasing in points during the complete process in the six (6) levels?

Answer: Yes. With your code number, you will see how your structure is in your six (6) levels. It is very important that you, as the main leader of the structure, reach the maximum in your first level. What is the maximum? The maximum is 45 and the minimum is what you achieve in your first 90 days. However, if you can achieve more than the maximum of 45, you will communicate with your direct leader to request an increase for your structure or write directly to ab.accounting@powerflowpr.com sending your code number and full name and stating that within your 90 days you can get more than 45 clients. All sales you can achieve in three (3) months, where the minimum recommended is six (6) sales in layaway format so that you can generate minimum income, if all your sales representatives within your structure do the same as you or more than you.

6. Refund and Replacement Conditions:

  • Non-refundable initial deposit: The initial deposit is non-refundable under any circumstances. And based on DACO regulations, it is expressly mentioned here, ensuring that you are fully informed before making any payment.
  • Replacement product: If the product is not available, we will provide you with one of the same quality and cost, ensuring that the replaced product matches the original in value and quality.

7. Third-Party Goods and Services

Our site may offer third-party goods and services. We cannot guarantee the quality or accuracy of the goods and services provided by third parties on our site.

While Tropichart Contractors Group LLC and Power Flow P.R. do not offer any warranty for third-party goods or services, any external provider offering goods or services through our site must comply with all applicable laws and regulations of the Commonwealth of Puerto Rico, including the consumer protection standards established by DACO.

Tropichart Contractors Group LLC and its affiliate Power Flow P.R. will not be responsible for the quality, accuracy, or compliance of third-party goods or services. Consumers are encouraged to verify the terms and conditions offered by external providers before participating in any transaction. Currently the only product that has a limited warranty is the Bochart watches, where you will send it directly to the manufacturer in Switzerland at your own shipping costs, and it has a warranty of up to two (2) years on some.

8. Sales Structure and Advancement

The Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan operates through a layaway sales system on our website, where participants or network customers can purchase one or more products through the layaway format by making a deposit. This deposit of one hundred twenty-five ($125.00) dollars is an initial deposit for the product in "layaway" payment and the start of your process for the Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan.

The deposit will be deducted from the total cost of the product or products including IVU for residents of Puerto Rico, and the remaining amount to be paid for the product or products is based on eighteen (18) convenient payments every thirty (30) days for the next eighteen (18) months for the start of the order and shipping process to your physical address. The system will provide the adjusted payment breakdown up to your product balance to complete the process for residents in Puerto Rico, the 48 contiguous states and their territories. During this payment period you can choose to make one or more payments in a single transaction by selecting these payments.

Applicable Deductions:

Residents of Puerto Rico, the 48 contiguous states and other territories have a mandatory deduction of 10% from each payment for maintenance and operating process of the powerflowpr.com platform. Regarding the deduction for being sales representatives of Tropichart Contractors Group LLC and Power Flow P.R., only residents of Puerto Rico have the mandatory 10% deduction according to the Treasury Department.

This retention will be shown on your form 480-A. To all residents of Puerto Rico annually according to what you have earned after the closing of each year on December 31 within the next 30 business days through your email account and/or postal service. Similarly, a deduction of fifteen (15%) will apply to all residents who live in the 48 contiguous states, not including Puerto Rico, because the headquarters offices are in Puerto Rico. For issuing payments outside the base office located in Puerto Rico. Those outside Puerto Rico will not receive any form to comply with the Puerto Rico Treasury Department.

A deduction of thirty (30%) percent will apply to all those who receive commission payments internationally, outside the United States of North America and its territories. This deduction will begin as soon as the platform is activated for international countries by the end of 2026, which includes network maintenance, the accounting process for shipping based on currency exchange, the banking process, and the shipping process will be automatically deducted from the commissions that will correspond to you for each level reached.

The program is structured around a sales-based hierarchy, where sales representatives and their leaders at each level according to their performance, including their personal sales and the sales of their team members.

The levels within this structure are as follows:

  1. Sales Representative:

    • Role: Sales representatives are in the entry-level position. They accumulate based on the layaway orders of their own participants.
    • Requirement: To remain active in the program, sales representatives must comply with continuous layaway orders from participants.
    • Advancement: Upon completing a minimum of 6 layaway sales per person per level and recruiting new sales representatives per member at each level, they are promoted to Sales Representative Coordinator.
  2. Sales Representative Coordinator:

    • Role: Coordinators supervise a minimum team of 6 sales representatives or more and earn points from both their own layaway and from the layaway sales made by their team.
    • Requirement: Coordinators must continue to meet the layaway sales performance objectives for themselves and their team to maintain their position in the structure.
    • Advancement: Once the coordinators' team members complete a minimum of 6 layaway sales and recruit a minimum of 6 new sales representatives each per level, they are promoted to Sales Representative Unit Supervisor.
  3. Sales Representative Unit Supervisor:

    • Role: Supervisors supervise the sales representative coordinators. They earn points based on the layaway sales performance of the coordinators and the overall performance of their unit.
    • Requirement: Supervisors must ensure that both they and their teams meet the established layaway sales quotas to achieve equivalent points every ninety (90) days to receive their corresponding commissions.
    • Advancement: Supervisors are promoted to Sales Representative Unit Manager when their coordinators' teams successfully meet their own layaway objectives and grow their respective teams, achieving higher points in the system.
  4. Sales Representative Unit Manager:

    • Role: Unit managers supervise the sales representative unit supervisors and are responsible for the overall performance of the entire sales unit. They earn points based on the layaways generated by the supervisors and their teams.
    • Requirement: Unit managers must ensure that their entire unit consistently meets the collective layaway objectives to earn points.
    • Reporting: Unit managers report directly to the Business Unit Leader and play a strategic role in driving layaways across the unit to achieve more points.
  5. Business Unit Leader:

    • Role: The Business Unit Leader oversees the performance of all Sales Representative Unit Managers within their business unit. They are responsible for setting strategic sales objectives and ensuring that the entire business unit meets its sales objectives. Points are earned based on the performance of the entire structure beneath them.
  6. Sales Structure Manager

    • Supervises the Business Unit Leader prior to this.
    • Supervisor of total sales, so they can recognize how much their final could be under the Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan.

Important information about the participants' level structure.

Each participant with a platform code only needs a minimum of six (6) participants who make a "layaway" in a period of three (3) months and thus will advance to the next level.

9. Installment Payments

We accept the following payment methods on our Site:

  • Credit Cards: Visa, MasterCard
  • PayPal

By providing us with your payment information, you authorize us to use and access the payment instrument you have chosen. We ensure that all transactions comply with the applicable consumer protection and electronic transaction regulations in Puerto Rico. We reserve the right to cancel or reverse your transaction if we believe your payment has violated any law, these Terms and Conditions, or the payment service provider's policies.

We do not accept personal checks, money orders, or any other payment method not mentioned above.

We take the security of your payment information seriously and ensure that all data is processed and stored securely in compliance with local and international regulations regarding data protection and secure transactions.

10. Shipping and Delivery

Delivery will be made through one of the following methods: Air freight with FedEx for all 48 contiguous states and ground shipping in Puerto Rico by USPS, for items weighing 70 lbs. or less, after full payment of the product is made in the 48 contiguous states, Puerto Rico and the U.S. Virgin Islands. Shipments of Kayaks, Electric bicycles, solar freezers, battery systems, solar systems, are specialized cargo as their shipping costs are higher due to their restrictions. Electric bicycles will only be delivered to residents of Puerto Rico.

Delivery will take place as soon as reasonably possible due to the high volume of deliveries and depending on the method available for the destination, weather conditions and methods available for the product. Delivery times are from 30 business days onwards, and may vary due to unforeseen circumstances, including delays caused by force majeure events, and do not include weekends or holidays.

You must pay shipping costs in addition to the price of the goods you purchase if delivery is outside Puerto Rico. Delivery within Puerto Rico is free. The shipping and handling cost for deliveries to the contiguous states of the United States has different costs depending on the weight, dimensions and requirements of the shipping company.

All buyers from Puerto Rico must also pay the IVU tax (11.5%) at the time of the transaction; the order is completed using our system's deferred payment process, which is available for up to 17 months which is seventeen (17) installments every thirty (30) days.

It is extremely important that you comply with these payments so that your sales structure remains active and you do not lose the opportunity to generate income through the commissions that will accumulate in your favor.

If you received commissions in your first levels and then your structure stopped having sales representatives enter through product acquisition in layaway format, you are obligated to complete the payment of your product in full in order to receive it. There is no refund for non-compliance on your part during the process of your structure within our network and under no circumstances. As of there being no more entries in subsequent levels, you will stop earning commissions from the Tropichart Contractors Group LLC and Power Flow P.R. Commission Plan.

You must provide a complete and accurate physical delivery address, including the recipient's name, phone and email. We are not responsible for any delivery errors caused by inaccurate or incomplete information provided by the buyer. In cases where goods are delivered to the wrong address or wrong person due to such errors, we are not responsible for any delay or cost associated with reshipping the item or theft of the item; we will not resend another item that was delivered to the provided address and was stolen or lost, that loss is your responsibility.

If the goods are stolen, you must go to the nearest police station and file a report; we are not responsible for sending the item again without it being purchased again by you. Tropichart Contractors Group LLC and Power Flow P.R. are not responsible for your loss; if your package was not delivered because the address was incorrect, then you must pick up the product at the Postal Service facilities that cover deliveries in your area. If this happened in the 48 contiguous states or the U.S. Virgin Islands, you must go to pick it up at the FedEx station in your area; any other delivery attempt has a charge that must be paid in full before delivery by sending an email to delivery@powerflowpr.com.

If you have any concerns regarding the status of your delivery, please contact us immediately. Our policies on returns or refunds for shipped goods are governed by applicable consumer protection laws in Puerto Rico, including those enforced by DACO. Please review our return policy if applicable, or contact us for further details.

11. Consumer Protection Law

Where consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. In Puerto Rico, this includes all protections provided under the laws enforced by the Department of Consumer Affairs (DACO). These Terms and Conditions will be interpreted as subject to the mandatory provisions of such legislation. If there is a conflict between these Terms and Conditions and the legislation, the mandatory provisions of the legislation will apply.

12. Limitation of Liability

Tropichart Contractors Group LLC and its directors, officers, agents, employees, subsidiaries and affiliates will not be liable for any action, claim, loss, damage, liability and expenses, including legal fees, arising from your use of the Site, except in cases of gross negligence, willful misconduct or violations of the law. This limitation of liability is subject to the applicable laws and mandatory consumer protection provisions in Puerto Rico, including those enforced by DACO. Where local law does not allow the exclusion or limitation of liability for damages, the provisions of such laws will apply.

13. Indemnification

Except where prohibited by law, by using this Site, you indemnify and hold harmless Tropichart Contractors Group LLC and Power Flow P.R. and their directors, officers, employees, subsidiaries and affiliates from any action, claim, loss, damage, liability and expenses, including legal fees, arising from your use of our Site or your violation of these Terms and Conditions. This indemnification is subject to the laws of Puerto Rico and the mandatory consumer protection provisions enforced by DACO. Where local law does not allow certain indemnifications, those provisions of the law will apply.

14. Applicable Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of the Commonwealth of Puerto Rico, including all applicable consumer protection laws and regulations enforced by the Department of Consumer Affairs (DACO). Any disputes arising from or related to these Terms and Conditions shall be resolved through binding arbitration, in accordance with the arbitration rules of the Commonwealth of Puerto Rico.

Arbitration shall be the exclusive remedy for any dispute, and the arbitrator(s)' decision shall be final and binding on both parties. Either party may seek injunctive relief in a court of competent jurisdiction in Puerto Rico to prevent irreparable harm pending arbitration.

15. Additional Terms

To become a member of the Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan, all interested parties must make a non-refundable deposit of one hundred twenty-five ($125.00) dollars when selecting their product on our site. This deposit will be deducted from the total cost of the selected product and serves as your initial registration, including the provision of your personal information. As a participant in the Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan, you will be required to provide certain personal information, including your full Social Security number and bank account data (such as bank name, account number and routing number). This information will be handled in compliance with all Federal and Puerto Rico data privacy laws, including the Gramm-Leach-Bliley Act (GLBA), and will be used exclusively for financial matters and for compliance with tax legislation.

Your Social Security number allows us to accurately create your payment, ensuring that your participation in the Points Payment System fully complies with all applicable regulations.

Please be assured that any personal information you provide, including your Social Security number and bank account data, will be used exclusively for financial purposes and compliance with the laws. We are committed to maintaining the confidentiality and security of your information, and all personal data will be handled in accordance with the highest data protection standards. Your information will not be shared or used for any other purpose outside of these legal requirements.

Participants must comply with the "layaway" sales quotas of a suggested minimum of 6 layaway sales per minimum sales representative per level within the three (3) month period that constitutes each level, up to a maximum of six (6) levels. The responsibility is individual; that is, when you begin your sales structure, your responsibility is to achieve the minimum of six (6) sales under your code in "layaway" format to maintain the possibility of generating good commission during your next levels and thus achieve your primary objective of completing your structure under the Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan.

No shipping process begins until full payment is completed within the first eighteen (18) months, and seventeen (17) payment installments every thirty (30) days following the initial deposit as will appear on your balances to pay until the item balance. These payment terms and conditions comply with the consumer protection regulations enforced by the Department of Consumer Affairs (DACO) in Puerto Rico.

16. Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, including the laws of the Commonwealth of Puerto Rico, those provisions will be deemed null and will be removed from these Terms and Conditions. The rest of the provisions will not be affected by the removal, and the rest of these Terms and Conditions will still be considered valid and applicable under the applicable laws of Puerto Rico.

17. Compensation Payment Structure

When a member of the Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan reaches the following sales milestones calculated by combining both their personal installment sales and the installment sales made by their subordinate team members, the system will automatically finalize their participation and send to our accounting office the total points reached in our Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan. This consists of one (1) installment sale in your structure equaling one (1) point. The process is 100% legal and real, based on the accumulation of points for each level configuration and installment sales through our powerflowpr.com network.

These payments under the Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan recognize both individual achievement and the ability to lead a successful installment sales team.

Award Conditions:

In compliance with DACO's Rule 27 on Gifts and Awards, the following conditions apply:

  1. No price increase: The price of the products or services associated with this award will not be increased due to the offer of the award. Unless the U.S. government increases the import tariff for some goods.
  2. Clear disclosure: Tropichart Contractors Group LLC and Power Flow P.R. will clearly and adequately identify and disclose all terms, conditions and limitations imposed on any commission granted by Tropichart Contractors Group LLC and Power Flow P.R. at the time you complete the Network Commission Plan.

Awards: The award will be determined by Tropichart Contractors Group LLC and Power Flow P.R. and notified through readable, visible, verifiable notification using press media, radio press and/or any other available means that members can access.

Tropichart and Power Flow currently do not have awards available to offer on the Network in Puerto Rico.

It is very important to mention that the award that Tropichart Contractors Group LLC and Power Flow P.R. decide to grant is a bonus that is not mandatory, that is not obligatory, and that Tropichart Contractors Group LLC and Power Flow P.R. will do it as a form of gratitude to those people who made formidable and successful structures.

Eligibility and rules: All winners of these bonuses who meet the conditions will receive them. The rules under Chapter VIII of the DACO regulations apply to residents of Puerto Rico. 18. Product Warranties

All products purchased through Tropichart Contractors Group LLC and Power Flow P.R. are covered by a limited warranty that applies exclusively to manufacturing defects, according to the regulations of the Department of Consumer Affairs (DACO) in Puerto Rico.

This warranty does not cover damages resulting from misuse, improper installation, negligence, unauthorized modifications, or any other action that falls outside the scope of manufacturing defects. The specific details of the warranty, including duration and covered parts, are indicated on the powerflowpr.com page where you begin the process of your layaway; it states the warranty time period there.

19. Warranty Claims and Shipping Responsibility:

In the event of a warranty claim, the customer is responsible for covering the shipping costs to send the item, unless DACO specifies otherwise in its regulations. The item must be sent using a service capable of handling heavier items, such as FedEx, and must include insurance covering the full value of the product. It must be in its original packaging, with all manuals and warranties included.

Tropichart Contractors Group LLC and Power Flow P.R. will not be responsible for any damage or loss related to shipping if the customer does not adequately insure the product. However, Tropichart Contractors Group LLC and Power Flow P.R. will cover all costs associated with repairs if the claim is deemed valid according to DACO guidelines.

20. Warranty Process:

Warranty claims must be initiated within the warranty period specified for the product within our powerflowpr.com sales system. Tropichart Contractors Group LLC and Power Flow P.R. reserve the right to inspect and verify the legitimacy of the claim before any action is taken. If, upon inspection, it is discovered that the defect is not covered by the warranty, the customer will be responsible for all costs associated with the inspection, return, shipping and any repairs made. If the defect is covered, Tropichart Contractors Group LLC and Power Flow P.R. will bear the costs of repair, replacement and product shipping, as required by DACO regulations for repairs and replacements.

If a customer requests a refund instead of a replacement under the warranty, the refund will cover the base cost of the product, excluding sales tax (IVU), any commission acquired in their first and second level, shipping expenses, the percent (%) charged for the transaction through cards or other fees, as allowed by DACO regulations.

Tropichart Contractors Group LLC and Power Flow P.R. will fully comply with DACO consumer protection laws, guaranteeing the customer's right to replacement, repair or refund. If a customer requests a refund under the warranty, any refund will deduct the initial deposit of one hundred twenty-five ($125.00) dollars because they are non-refundable, shipping expenses, IVU paid, percent (%) charged by the credit card, import costs that Tropichart Contractors Group LLC and Power Flow P.R. have paid.

21. Fraud Prevention and Restrictions:

To prevent fraudulent or abusive warranty claims, Tropichart Contractors Group LLC and Power Flow P.R. reserve the right to deny warranty coverage in cases where there is evidence of repeated claims that appear to be abusive, opportunistic or made in bad faith. Tropichart Contractors Group LLC and Power Flow P.R. may limit the warranty service to the original purchaser of the product and require proof of purchase and identification before processing any warranty claim. By accepting these terms, the customer agrees to comply with DACO regulations and acknowledges their right to file a claim with DACO in case of any dispute regarding this warranty.

22. System Changes

These Terms and Conditions may be amended from time to time to maintain compliance with the law and to reflect any changes in the way we operate our Site and the Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan, as well as any updates on how we expect users to interact with our Site.

Any changes that may affect the rights or obligations of users will be communicated in advance, in compliance with DACO regulations.

We make changes to these Terms and Conditions at any time without prior notice; it is very important that all sales representatives periodically review these Terms and Conditions to acknowledge any changes. Our Site will publish the changes at least 30 days before the changes take effect, giving users the opportunity to review and accept the modified terms.

If users continue to use the Network after the effective date of the revised Terms and Conditions, this will indicate their acceptance of the changes. However, if a user does not agree with the revised terms, they have the right to discontinue use of the Site and any related service, including participation in the Tropichart Contractors Group LLC and Power Flow P.R. Network Commission Plan.

  • The following brands (TRAHCO, PALAGUA, BOCHART, PRORUEDAS AND POWER FLOW) on our website (POWER FLOW PR): the main brands are registered in the US Trademark under Tropichart Contractors Group LLC; others are directly related to our founder's name and we hereby record this.
  • The cost of our products fluctuates between $475.00 dollars and $30,000.00 dollars.
  • Only certain products will be available for sale and development of sales structures in our PowerFlowPr Network; the others will appear disabled.
  • If at the end of the eighteen (18) months you have not complied with the full payment of your item, the pending balance will be deducted from your next commission payment with a fine of 5% of your last commission payment.
  • Being in our system means you accept all our Terms and Conditions presented here, including the format for payments and commission collection.

International:

All payments are based on the currency of the United States of North America and are changed to the currency of your country. The deduction for payments per cycle will be 20% and for the operational maintenance of the system is 10%, the remaining commission will be sent through monetary transfer using banking or Western Union, and/or the most reliable method that can be achieved.

Provide the correct address with your full name, your street name, your house or apartment number, with the county name and with the correct postal code. If the address is incorrect, your envelope with the company check payment will be kept at your nearby FedEx office and you have the responsibility to pick it up before the FedEx time expires. The same applies to product shipping; in case there is no one at home, you must pick up the product at your closed FedEx office.

No second delivery will be attempted for incorrect and/or incomplete addresses.
